 Clarifying Misconceptions Regarding Maui's Bill 9 Proposal

There has been a lot of misunderstanding, especially among people on the mainland, about Maui’s Proposal 9. This proposal seeks to phase out short-term rentals in certain apartment-zoned areas, specifically A-1 and A-2. The key point is that Proposal 9 does not eliminate all short-term rentals on Maui. Properties that are already properly zoned Hotel (H1 to H4), as well as those with existing and valid transient vacation rental permits, are not affected by the proposal. Maui will still have many legal short-term rental options regardless of the vote.

Another important clarification is that even if Proposal 9 passes, it is very likely that many condo complexes currently zoned A-1 or A-2 will pursue rezoning to Hotel zoning, particularly H3 or H4. This path has strong support because many of these complexes have operated as vacation rentals for decades, they provide essential visitor accommodations that support Maui’s economy, and the County has stated that rezoning is a legitimate option for properties that function like hotel use but are technically apartment-zoned.

Because of this, even in a worst-case scenario, many existing short-term rental condos will probably continue operating after obtaining new zoning. The idea that all short-term rentals will be banned is simply not accurate.

It is important that we correct these misconceptions. False rumors are already causing unnecessary fear among buyers, owners, and visitors. Maui depends on responsible tourism, and clear information helps protect homeowners, businesses, and the island’s economy. Accurate communication reassures investors and travelers that Maui will continue to welcome visitors and that the future of many vacation rental properties remains strong.
