Service animals make a lot of people's lives easier. It's amazing how service dogs can open doors, turn on lights and warn of deadly seizures.
Earlier this month a new law came in to effect establishing a civil penalty for fraudulently representing a dog as a service animal. The intention of the law is to discourage people from misrepresenting their dog as a service animal to get the animal permitted into establishments where dogs are otherwise not allowed.
Federal fair Housing and the Americans with Disabilities Act require reasonable accommodation be provided to those in need of service animals. This new law does not affect these requirements.
The ADA's definition of a service animal is an animal trained to do work or preform tasks for persons with disabilities. This definition excludes comfort or support animals who cannot preform tasks.
The FHA's definition of an assistance animal is broader and includes animals trained to do tasks as well as those who provide support and comfort. By law fair housing is to be provided to those with either a service or assistance animal and not affected by this new law.
