Maui County Will Attempt to Ban Short Term Rentals for Certain Condos
Mayor Bissen announced on Friday that he will ask the Maui County Council to pass a law repealing the previous law that allowed condos on the Minatoya list to rent on a short term basis.
Here is a brief history of how this came to pass.
- Around 2002, an owner at Haleakala Shores complained to the County about short term rentals taking place in that complex which he felt was illegal because it was zoned for Apartment Use, i.e. long term rentals only.
- The Corporation Council for Maui County, Richard Minatoya, issued an opinion that all condos in Maui in apartment zoned districts that were operating short term rentals prior to 1992 should be allowed to continue to do so. This became known as the Minatoya List.
- In 2016, the County Council codified this opinion making it a law giving those owners on the Minatoya List the right to rent their condos on a short term basis, i.e. less than 6 months.
- On May 2nd, the State Governor, Josh Green, signed legislation authorizing the Counties to regulate short term rentals.
- On May 3rd, the Mayor of Maui County, Richard Bissen, announced his plans to push legislation to repeal the law allowing Minatoya condos to do short term rentals.
The stated intention of this new law will be to create more affordable housing. One thing I believe we can all agree on is that we do need more affordable housing; however, is this the solution?
What might be the unintended consequences? If we eliminate 7000 short term rentals, how many of these will end up being affordable long term rentals and how will this affect tourism, which is the lifeblood or our economy. Most owners of short term rentals will not be able to afford renting them out as long term rentals.....at least not at the current market prices for these condos. If the prices were to drop by 50% or more, then new owners might be able to purchase them and rent them out long term.
Regardless of where you stand on this issue, it has already created a lot of uncertainty in the market place which is causing many owners to consider selling and many buyers to pause on their decisions to buy.
