Title and Tenancy 

TITLE TO THE PROPERTY A property title is a legal concept that establishes ownership of real property and the rights and responsibilities that come with it. It's often represented by a document such as a deed or certificate of title, that shows the propery's history and legal owmership. Titles can be held by individuals, corporation, partnerships, trusts, and other legal entities.

Titles can be held in several ways, including: 
  • Sole ownership: One person holds the title in their name. This is often used by single people or spouses who are buying a property as an investment.
  • Collectively: Two or more people hold the title, such as a married couple. 
  • Joint tenancy: The title is held jointly, with the right of survivorship. 
  • Tenants in common: The title is held in common with other tenants. 
A title gives the owner the right to possess, use, and enjoy the property, as well as sell, rent, or transfer ownership. It also limits who can enter the property and determines how it will be passed on if the owner dies or experiences financial difficulties. 
A title is different from a deed, which is a physical document that transfers ownership of a property from one party to another. A title report can help identify any issues with a property's title, such as encroachments, assessments, or covenants. An abstract of title is another document that can be helpful when selling a property, as it details the property's legal history and chain of ownership.

TENANCY IN SEVERALTY Ownership of property vested in one person alone and not held jointly with another, also called Several Tenancy or Sole Tenancy. When the sole owner dies the property is probated and passes to his/her heirs or devisee.

TENANCY IN COMMON A form of concurrent ownership of property between two or more persons in which each has an undivided interest in the whole property. Each co-tenant is entitled to the undivided possession of the property, according to his proportionate share and subject to the rights of possession of the other tenants. Their interests may be equal (as in joint tenancy) or unequal. Where the conveyance document does not specify the extent of interest of each co-tenant, there is a presumption that the shares are equal. There are no rights of survivorship. Any tenant in common can sell his interest in the property without the consent of his co-tenants.


JOINT TENANCY A form of property ownership by two or more persons in which the joint tenants have one and the same interest, arising by one of the same conveyance, commencing at one and the same time and held by one and the same possession (the concept of the “four unities”). A distinctive feature of the joint tenancy is the right of survivorship by which the surviving joint tenant(s) succeeds to the interest of the deceased joint tenant. No probate proceedings are necessary.

TENANCY BY THE ENTIRETY A special joint tenancy between lawfully married couple, civil union or reciprocal beneficiaries which placed title to the property into the unit and both tenants having an equal, undivided interest in the whole property. Upon the death of one tenant, the survivor succeeds and take title to the entire property to the exclusion of heirs and creditors of the deceased tenant and without the need for probate. A tenancy by the entirety differs from a joint tenancy in that neither spouse can convey his or her interest or force a partition during the lifetime of the other without the consent of the other spouse. Property held under a tenancy by the entirety may not be attached to the debts and obligations of only one tenant.
