Under the deal, the County of Maui will waive nearly $2 million in accrued fines against the complex, provided the homeowners association fully installs the long-delayed public pathway within one year of securing the necessary permits.

The issue finally resurfaced in 2020 when the Maui Department of Planning received a formal public complaint, prompting an investigation into the property’s non-compliance.

While the un-enforced conditions resulted in potential code violation fines crawling toward the $2 million mark, county officials clarified that the goal was never about collecting a massive payout.

“The department's priority here is public access,” stated Kristin Tarnstrom, deputy corporation counsel for Maui County. “We really just wanted to bring all the parties together and get access to this beach, which has been denied the public for many decades.”

However, the decision also brought up mixed reactions from the planning commission. While representatives for the property owners called the compromise a win-win, Planning Commissioner Mark Deakos noted that the situation highlights an ongoing, frustrating battle between private beachfront developments and the public's right to access the shoreline, calling the long delay an "abuse to the public trust lands."

Hale Mahina sits on a stretch of West Maui coastline alongside three other older complexes—the Lokelani Condominiums, Hoyochi Nikko, and Kuleana Resort. Because those neighboring properties were built entirely before the 1977 Coastal Zone Management Act went into effect, they were never bound by the same public access mandates. This makes the upcoming path at Hale Mahina a particularly valuable entry point for the surrounding neighborhood.
